On 27 February Barry Stancombe and Penny Small joined a select number of experts to speak at a Financial Investigation Conference in Belfast. The event was jointly hosted by the Northern Ireland Organised Crime Task Force and the Northern Ireland Environment Agency, and was attended by investigative and environmental officers from both Northern Ireland and the UK.
The pair presented "A review of defence barriers to asset recovery in criminal restraint and confiscation proceedings". Penny focused on asset recovery specific to matrimonial claims, including the nature of claims made on matrimonial property, relevant legislation and case law on matters such as tainted gifts and ancillary relief proceedings. Barry reviewed defence barriers to asset recovery in criminal restraint and confiscation proceedings. Specific issues included the identification of realisable assets, piercing the corporate veil, insolvency and trusts.
