Faisal Osman successfully defended a complex commercial dispute involving the prestigious sports betting brand Parimatch.
The case centered on a partnership dispute over a Turkish-speaking market venture. Following poor financial performance, the defendants terminated the arrangement after the initial trial period. The claimant sought declarations that the arrangement remained in force and claimed €1.7M in compensation, along with serious allegations of conspiracy.
After a two-week trial, the Court comprehensively dismissed all claims. The judgment (available here) notably addressed key commercial principles around performance metrics and contractual interpretation. The case also yielded an important procedural precedent on costs budgeting, with the Court approving an exceptional eight-fold increase in the costs budget due to extraordinary circumstances.
The judgment serves as a reminder that conspiracy allegations must be properly evidenced and that commercial disputes should be assessed in light of business realities. A deep understanding of the market in which a client operates is essential.
