Christopher Convey – Section 23 PoCA Application Success – Client immediately released

Christopher Convey, instructed by James O’Hara of Imran Khan & Partners, acted for IK in a successful application pursuant to Section 23 PoCA 2002 – formerly known as a certificate of inadequacy application.

Christopher’s client had previously had a Confiscation Order made against him in 2016 for just over £4,000,000. 

 

The client’s default sentence having been activated, Christopher was instructed to advise upon and represent IK in an application for a s.23 reduction of his confiscation order.

As a result of the written submissions presented by Christopher, the matter was swiftly resolved, with the prosecution consenting to the reduction of the amount to pay by £2,100,000.

With a listing arranged immediately, the s.23 Order was made, resulting in the release of the client the same day.

 

This was a highly satisfactory result in a case of considerable complexity involving overseas investments, corporate holdings, trusts and property rights. 

The client had been seeking for some time to obtain a variation of his confiscation order before instructing Christopher Convey and James O’Hara.

It once again demonstrates the critical importance of instructing experts in this complex and ever-demanding field of law.
