Metropolitan Police investigative and disclosure failings result in jury acquittal of a Solicitor in criminal proceedings.
Narita Bahra QC was instructed to a represent a Solicitor in criminal proceedings. The Solicitor voluntarily attended police interviews in July 2020 and was charged by postal requisition in September 2020. The case was tried in July 2022 by which time the client’s mental health and well-being had deteriorated. During the trial, Narita exposed through a combination of targeted disclosure requests and cross-examination of witnesses, substantial investigative and disclosure failings by the officer in the case, who was also assigned as the investigative and disclosure officer.
The failings were elicited before the jury.
The jury returned not guilty verdicts on all counts.
