Successful outcome in FCA case for Graham Brodie KC

FCA v (1) Papadimitrakopoulos, (2) Gryparis

In 2021, Graham Brodie KC was instructed by BCL Solicitors, to represent Costis Papadimitrakopoulos, the former CEO of Globo plc, in a civil claim commenced by the FCA in which Mr Papadimitrakopoulos and the former CFO of the company, Dimitris Gryparis, were accused of market abuse.

In November 2022, Joanna Smith J accepted submissions advanced on behalf of Mr Papadimitrakopoulos and Mr Gryparis that the conduct of the FCA in the context of the claim amounted to an abuse of the process of the court, but declined to order that the claim should be struck out: https://www.bailii.org/ew/cases/EWHC/Ch/2022/2792.html  Following this judgment, however, on 4 March 2024, the FCA agreed to abandon the claim in its entirety.

Moreover, following representations made on behalf of both Mr Papadimitrakopoulos and Mr Gryparis to the effect that any criminal proceedings would violate the prohibition against double jeopardy, the FCA has also agreed to discontinue criminal proceedings it had commenced: https://www.fca.org.uk/news/statements/fca-discontinues-criminal-proceedings-konstantinos-papadimitrakopoulos-dimitris-gryparis
