Success in the Court of Appeal for John Carl Townsend

R v Hughes (Catherine) [2024] EWCA 357

John Carl Townsend was instructed to represent the interests of Catherine Hughes, who is the owner of land in the Republic of Ireland in which she holds both the legal and beneficial interest. Ms Hughes was an entirely innocent third party to the proceedings before the Crown Court and had intervened pursuant to s.10A POCA. Her application at first instance and on appeal raised issues of chancery law relating to rights over land and the doctrine of proprietary estoppel. Ms. Hughes was successful in her appeal with the Court clarifying the circumstances in which an appeal made pursuant to s.31(4) POCA can be remitted to the Crown Court for rehearing.
